1. USE OF THE CLASSICAL RIDING CLUB WEBSITE (The CRC Site) - The CRC Site is provided to you free of charge only for your personal use, subject to these Terms and Conditions. 2. THE CLASSICAL RIDING CLUB - For the purposes of these Terms and Conditions, the terms 'we' and 'CRC' refer to The Classical Riding Club. 3. AMENDMENTS - We may update these Terms and Conditions from time to time. Any such changes will be published in the News section on the CRC Site. The changes will apply to the use of the CRC Site immediately after they have been published. If you continue to use the CRC Site after the date on which the change comes into effect, your use of the CRC Site indicates your agreement to be bound by the new Terms and Conditions. If you do not wish to accept the new Terms and Conditions you should not continue to use the CRC Site. 4. REGISTRATION - When you register to use the CRC Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be wholly responsible for all activities and orders that occur or are submitted under your password, even if they occurred without your knowledge. If you know or suspect that someone else knows your password you should notify us by contacting the Site Administrator (see below for contact details) immediately. If the CRC has reason to believe that there is likely to be a breach of security or misuse of the CRC Site, we may require you to change your password or we may suspend your registration in accordance with paragraph 8 below. 5. EXCLUDED SERVICES - The services provided by the CRC Site do not include the provision of a computer or other necessary equipment to access the CRC Site. To use the CRC Site you will require an Internet connection and appropriate telecommunication links. The CRC shall not be liable for any telephone or other communication or legal or other service costs that you may incur. 6. INTELLECTUAL PROPERTY - The content of the CRC Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the CRC Site on a computer screen. You may not store such content in electronic form on disk, server or other storage device connected to a network. You may print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the CRC Site without written permission, signed by a Director, from the CRC. No license is granted to you in these Terms and Conditions to use any trademark of the CRC. 7. LIMITATIONS - You may not use the CRC Site for any of the following purposes: * disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or any material denigrating in any way The CRC itself. * transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice * gaining unauthorised access to other computer systems * interfering with any other person's use or enjoyment of the CRC Site * breaching any laws concerning the use of public telecommunications networks * interfering or disrupting networks or web sites connected to the CRC Site * making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner You accept that The CRC reserves the right at its sole discretion to refuse to post material on the CRC Site or to remove material already posted on the CRC Site without notice. You will indemnify us against all costs, claims, damages, expenses, liabilities, and losses suffered, directly or indirectly by The CRC as a result of the posting of material supplied by you on the CRC Site. The CRC, it’s Directors and Administrators under any judgment by a court of competent jurisdiction, all settlements and any damages or sums paid may recover by us as a result of any settlement agreed by us arising out of or in connection with * any claim by any third party that the use of the CRC Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice; * any claim by any third party that the use of the CRC Site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the CRC Site by you. 8. AVAILABILITY OF THE CRC SITE - The CRC intends to supply as reasonable a standard of service as possible, but cannot, and will not promise that the service of this site will meet your requirements. The CRC cannot guarantee that the service will be fault free. The CRC will attempt at all times to minimise disruption to the service. 9. The CRC’s RIGHT TO SUSPEND OR CANCEL YOUR REGISTRATION - The CRC may suspend or cancel your registration, without notice, immediately at our reasonable discretion, or if you breach any of these Terms and Conditions. 10. The CRC's LIABILITY - The CRC Site is provided by the CRC without any warranties or guarantees as to performance or fitness for performance. You must bear and accept the risks associated with the use of the Internet. The CRC will not be responsible for any errors or omissions in 3rd party content provided on the site, or for any technical problems you may experience with the CRC site. If the CRC is informed of any inaccuracies in the material on the site we will attempt to correct such inaccuracies as soon as we reasonably can. In particular, but without prejudice to the generality, we disclaim all liabilities in connection with the following: * incompatibility of the CRC site with any of your equipment, software or telecommunications links * technical problems including errors or interruptions of the CRC site * unsuitability, unreliability or inaccuracy of the CRC site * inadequacy of the CRC site to meet your requirements. To the full extent allowed by law, you agree that we will not be liable to you or any third party for any direct, indirect or consequential damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other direct or indirect, special or punitive damages whatsoever that arise out of, or are related to the CRC site. Our acceptance of a purchase order takes place on dispatch of the goods subject to the order, at which point the purchase contract will be made and you will be charged for your order and you will be liable for payment of your order. 11. THIRD PARTY WEBSITES – The CRC may at its discretion include links to other web sites or material, which is beyond its control. The CRC is not responsible for content on such third party websites or pages. 12. APPLICABLE LAW - These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland, and any disputes will be decided only by the Scottish courts. 13. INTERNATIONAL USE - If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws. 14. MISCELLANEOUS - You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and the CRC takes no immediate action, the CRC will still be entitled to use its rights and remedies at a later date or in any other situation where there is a breach of the Terms and Conditions. The CRC shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control. A person who is not party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any terms of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act. DELIVERY 1. Mainland UK - All our orders are usually processed and dispatched within 5 working days of receipt of your order. Delivery is by the UK Post Office regular dispatch services (except by separate arrangement). 2. Overseas Orders (including Channel Islands and Eire) - We will gladly send your order to an overseas address. In this case, your charge needs to be worked out by weight. Please order as normal and you will be contacted by the CRC office to confirm your delivery charge. 3. Out of Stock - On occasion products may be out of stock. In this case, your order will either be part-sent, including advice on when the rest of your order will be dispatched, or we will contact you to advise you of the likely dispatch date. We will only charge your credit card for the goods ordered when they are actually dispatched. 4. Expiry Date On Payment Card - Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfill your order. 16. PRODUCT DESCRIPTIONS - We have made every effort to ensure that our product descriptions and details are accurate. However, slight differences in colours and apparent textures of products may occur, as internet technology does not allow true colours to be replicated. 17. SECURITY - All of your transactions via the CRC website are secured as well as possible by the use of the Secure Socket Layer (SSL) protocol. 18. MISCELLANEOUS TERMS AND CONDITIONS - Items on this site are offered for the benefit of interested individuals. Goods remain the property of the CRC until a successful payment transaction has been completed. Faulty or damaged goods should be returned immediately to the CRC at Eden Hall, where a credit will be refunded. The CRC will refund the original postage cost but will not pay for the costs of returning such goods. The CRC is in no way liable for any loss, injury or damage, howsoever caused, as a direct or consequential result of the use or misuse of any of the merchandise offered for sale.
